Terms and Conditions
These Terms and Conditions govern the access and use of NotAwait’s website, digital products, and professional services. By accessing the site or contracting our services, you acknowledge that you have read, understood, and accepted these provisions.
1. Identity of the provider

These Terms are addressed to clients and visitors located in the Republic of El Salvador, without prejudice to mandatory rules that may apply to international users.
2. Applicable legislation
These Terms are interpreted under the laws of the Republic of El Salvador, including the Consumer Protection Law, the Commercial Code, and applicable regulations on electronic contracting.
3. Scope of services
We offer consulting, design, development, implementation, and maintenance of digital products and software solutions. Each engagement is defined through proposals, statements of work, or service orders agreed with the client.
- Deliverables, acceptance criteria, and timelines will be detailed in the corresponding commercial documents.
- Any third-party licenses or cloud services will be subject to their own terms and costs.
4. Account and user responsibilities
You are responsible for the accuracy of the information provided, the proper use of credentials, and for preventing unauthorized access to systems delivered by NotAwait.
You agree not to misuse the site or services, attempt to interfere with their operation, or exploit vulnerabilities.
5. Fees, billing, and payments
Prices, payment schedules, and currencies will be specified in the accepted proposal or contract.
Unless otherwise agreed, invoices are due upon receipt. Late payments may accrue applicable charges under Salvadoran commercial law.
6. Intellectual property
Pre-existing materials, methodologies, and know-how developed by NotAwait remain our property.
Unless otherwise agreed in writing, once the client completes payment, ownership of the specifically commissioned deliverables is transferred to the client, without prejudice to third-party components subject to their own licenses.
7. Confidentiality
Both parties will protect confidential information received and use it only to fulfill the contracted services.
Obligations of confidentiality will survive contract termination to the extent permitted by Salvadoran law.
8. Personal data protection
The processing of personal data is governed by the Personal Data Protection Law of El Salvador and our Privacy Policy.
If NotAwait processes personal data on your behalf, the parties will enter into the corresponding data processing agreement and ensure adequate technical and organizational measures.
9. Service availability and maintenance
We strive to provide reliable services but do not guarantee uninterrupted availability. Planned maintenance windows or incidents will be communicated when feasible.
Third-party service interruptions (hosting, APIs, payment gateways) are subject to their own service levels.
10. Liability limitation
To the maximum extent permitted by Salvadoran law, NotAwait will not be liable for indirect, incidental, or consequential damages, loss of profits, or loss of data arising from the use or inability to use the services.
Our total liability under these Terms will be limited to the amounts effectively paid by the client for the services that gave rise to the claim.
11. Modifications
We may update these Terms to reflect legal, operational, or service changes. When changes are material, we will provide prior notice through the website or direct communication.
Continued use of the site or services after the effective date of the changes constitutes acceptance.
12. Dispute resolution and jurisdiction
The parties will first seek to resolve disputes amicably. If no agreement is reached, the competent courts of San Salvador, El Salvador, will have jurisdiction, except for mandatory venues established by consumer regulations.
